The meeting of the Council of the Village of Chagrin Falls was called to order at 8:08 p.m. by Mr. Patton.

Member present: Evans, Jacobs, Lutz, Patton, Subel, Williams
Members absent: Milko
Officials present: Mayor Brick, Bloom, Himes, Alunni, Brosius, Byron, Lannon

Moved by Mr. Subel, seconded by Mr. Williams that the absence of Mr. Milko be excused. Carried. Ayes: Evans, Jacobs, Lutz, Patton, Subel, Williams. Nays: None.

APPROVAL OF MINUTES

Moved by Mrs. Evans, seconded by Mr. Williams that the minutes of the meeting held April 11, 2011 be approved. Carried. Ayes: Evans, Jacobs, Lutz, Patton, Subel, Williams. Nays: None.

REPORT OF THE MAYOR

Mayor Brick introduced a group of students from Case Western Reserve University, School of Management, who made a presentation regarding their findings on a study to identify and describe best practices proven to increase efficiency of operations. Comments were heard and questions were answered.

Mayor Brick read a proclamation designating April 28, 2011 as Arbor Day in the Village.

Mayor Brick reminded everyone that we are having a community shredding event on Saturday, May 7, 2011 from 9:00 a.m. to 12:00 p.m. in the school parking lot on Philomethian Street.

Mr. Jacobs showed a DVD from when CNN reported from Chagrin Falls because of the severe winter weather we had.

REPORT OF THE LAW DIRECTOR

SECTION 149.06 OF THE CODIFIED ORDINANCES AMENDED
Mr. Byron placed on the floor Ordinance No. 2011-22 entitled:

AN ORDINANCE AMENDING SUBSECTIONS (A) AND (D) OF SECTION 149.06 OF THE CODIFIED ORDINANCES OF THE VILLAGE OF CHAGRIN FALLS RELATING TO OVERTIME, AND DECLARING AN EMERGENCY.

Moved by Mr. Subel, seconded by Mrs. Evans that the ordinance be adopted. Carried. Ayes: Evans, Jacobs, Lutz, Patton, Subel, Williams. Nays: None. Mr. Subel said the Village, a few years ago, had a change of practice for the police officers who went to twelve hour days versus eight hour days. It has worked well and this legislation allows us to do this for the dispatchers without having to pay overtime for over eight hours. He said the compensation committee voted to recommended this to Council to pass.

AUTHORIZATION TO ENTER INTO AN AGREEMENT WITH THE DEPARTMENT OF TRANSPORTATION
Mrs. Evans introduced Resolution No. 2011-24 entitled:

A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO AN AGREEMENT WITH THE DEPARTMENT OF TRANSPORTATION TO CONSTRUCT CERTAIN IMPROVEMENTS WITHIN THE VILLAGE OF CHAGRIN FALLS.

Moved by Mrs. Evans, seconded by Mrs. Lutz that the resolution be adopted. Carried. Ayes: Evans, Jacobs, Lutz, Patton, Subel, Williams. Nays: None. Mrs. Evans said this is a resolution to implement some of the Safe Routes to School Program that we approved at our last meeting. It includes the ten foot wide sidewalk at the middle school, including additional sections of sidewalk, constructing a new fence, re-stripe the crosswalk at the intermediate school, and bike racks. Comments were heard and questions were answered.

CUYAHOGA COUNTY EMERGENCY OPERATIONS PLAN ADOPTED
Mrs. Lutz introduced Resolution No. 2011-25 entitled:

A RESOLUTION ADOPTING THE CUYAHOGA COUNTY EMERGENCY OPERATION PLAN.

Mrs. Lutz put this resolution on readings.

SECTION 149.20 OF THE CODIFIED ORDINANCES AMENDED
Mr. Subel introduced Ordinance No. 2011-26 entitled:

AN ORDINANCE AMENDING SECTION 149.20 OF THE CODIFIED ORDINANCES OF THE VILLAGE OF CHAGRIN FALLS RELATING TO OPERS PICK-UP AND REPEALING SECTION 149.21 OF THE CODIFIED ORDINANCES OF THE VILLAGE OF CHAGRIN FALLS RELATING TO OPFDPF PICK-UP , AND DECLARING AN EMERGENCY.

Mr. Subel put this ordinance on readings.

STREETS AND SIDEWALKS COMMITTEE

Mrs. Evans reported that the committee discussed coming up with some kind of plan to grant banner requests. She said they approved the recommendation of planning and zoning for the Comprehensive Plan in regards to streets and sidewalks and that is a change that encourages installation using the Village’s sidewalk priority system. The committee discussed purchasing an asphalt roller in conjunction with Bentleyville and they heard an update on the Cleveland Street and Mill Street project.

Mr. Jacobs reported that the commission reviewed Section 11436.04(b), Illuminated Signs, and decided to take no action.

Kathryn Garvey mentioned the following up-coming events:

Annual Bike Rodeo, which is now Bike-A-Palooza, on Saturday, April 7, 2011 at the intermediate school from 12:00 p.m. to 3:00 p.m.;
First annual Back-to-School Day for intermediate school students on Thursday, May 12, 2011.

Chief Brosius announced that there will be a spaghetti dinner on Saturday, April 30, 2011 and all the funds from that go to support the soldiers and their families at the Chagrin Falls Armory 135th Military Peace Company.

Jim Weingart said he owns a property on Cottage Street and he expressed his concerns about the hill that is being constructed for condominiums on West Orange Street.

Mark Piunno also expressed his concerns about the hill that is being constructed on West Orange Street. He asked why the Village gave permission to excavate without the permits to do it?

Mr. Patton said they had soil borings as part of the whole analysis. Mr. Himes explained that one of the reasons for the delay is that we asked for additional testing. Their original soils were bored and our review of that report didn’t match up. Ultimately a third party geotechnical engineer came in and made some recommendations. They have been waiting to do the testing but the weather has really held them off. Mr. Patton asked if the issue is under review right now? Mr. Himes said right. With regard to the Mitchell property, they did notify us that they felt that there was movement on their property so I immediately had the engineer and building inspector inspect it and they can give you their report if you like. Mr. Patton said the next step is waiting for this third party analysis. Mr. Himes said right, from the third party geotech analysis a scope of additional testing was developed and we are simply waiting now for them to be able to get in there and do that testing. They’ve got foundation permits for the first three buildings on the eastern portion of the parcel. The three western parcels need additional retaining structures so that is where the additional testing is needed. Until there is an approved retaining system they can’t build on those three western lots.

Mr. Lannon said we inspected the Mitchell property and there has been damage over the years, I think, but it has accelerated recently, cracks in the basement floor and things like that. We can’t determine if it is directly related to the work at the bottom of the hill. We met with the developer and asked them to do what they can to move their studies along and get us an approval plan as soon as possible.

MISCELLANEOUS

Mrs. Evans announced that the Your Life...Your Choice Program will be held tomorrow morning at 10:00 a.m. at Parkside Church in Bainbridge. This program is sponsored by the Village of Chagrin Falls and particularly by the Chagrin Falls Police Department. I would urge you to attend if you have never gone. It is a wonderful program and my understanding is that this might be the last one so I would really urge you to attend.
