CHARTER REVIEW COMMISSION
April 25, 2006

The meeting was called to order at 7:07 p.m. by Chairman Lydia Champlin
Mr. Subel suggested that the Commission consider changes they may need to protect residents from new eminent domain rulings. It was asked if that would be a Charter amendment or would Council have to pass legislation? This will be looked into further.
Questions from 04/18/06 meeting:
“Mrs. Champlin brought up the question of whether or not a felony would fall in with any of the reasons for removal of the Mayor?: Gross misconduct, malfeasance, misfeasance or nonfeasance in or disqualification for office, or the conviction while in office of a crime involving moral turpitude, or if adjudicated legally incompetent or for a violation of the oath of office.”
Mrs. Champlin said Mr. Diemert advised that it is all covered in a felony including embezzling and soliciting prostitution. He feels that they are adequately covered with that specific wording.
“Mrs. Champlin said being chief conservator is the same as safety director and that is not spelled out in the Charter.”
Mrs. Champlin said Mr. Diemert advised that chief conservator is the exact same thing as safety director.
The Commission agreed that they should have input from Council before they conclude their mission. It was suggested that June 6 would be a good time. They reviewed Article IV, Council. There was lengthy discussion; no changes were made at this time. Section 6, Vacancies, will be addressed again. They suggested that they ask for some clarification on Section 7, Council Meetings, regarding “a lesser number, than a quorum, may adjourn the meeting”.
Mr. Subel and the Commission further commented on eminent domain.
The meeting adjourned at 8:02 p.m.
