The meeting was called to order at 7:15 p.m. by Chairman Steven Patton.

UTILITY BILL APPEAL - 40 SOUTH MAIN STREET

Mr. Himes said at their last meeting, in May, they decided that more data should be gathered before they decided if a compromise was warranted in this situation. He said since then they have estimated what the current usage was between May 15, 2009 and August 6, 2009, which was about 12.2 cubic feet per day. He multiplied that by the number of days since Mr. Hughes took ownership of 40 South Main Street and that worked out to be 66,294 cubic feet and the charges for that under our current rate is $6,947.70,which is approximately one half of the original bill of $14,686.74. He recommends that they bill Mr. Hughes the $6,947.70.

Moved by Mr. Williams to accept the recommended $6,947.70 charge for the water use. Mr. Patton said since Janis is recusing herself, I better second that. Carried.

LICENSE AGREEMENT - 540 EAST WASHINGTON STREET

Mr. Himes explained that the Village has a ten foot parcel that runs right next to this building so the owners of the property have asked for formalization of the condition that has been existent for years. This license agreement would give them the right to continue to use it as a parking lot.

Moved by Mr. Patton, seconded by Mrs. Evans that we recommend to Council that we pass the ordinance for the license agreement between the Village and the Lombardos. The motion carried unanimously.
