The meeting of the Council of the Village of Chagrin Falls was called to order at 8:00 p.m. by Mr. Patton.

Member present: Evans, Jacobs, Lutz, Milko, Patton, Subel, Williams
Members absent: None
Officials present: Mayor Brick, Bloom, Zugan, Brosius, Byron, Lannon

APPROVAL OF MINUTES

Moved by Mr. Williams, seconded by Mrs. Evans that the minutes of the meeting held August 9, 2010 be approved. Carried. Ayes: Evans, Jacobs, Lutz, Milko, Subel, Williams. Abstain: Patton. Nays: None.

REPORT OF THE MAYOR

Mayor Brick said I hope you and all of Council will join me in welcoming our visiting Chinese high school students and teachers. He said, to all our Chinese guests, my name is Thomas Brick and I am the Mayor of Chagrin Falls. With me are the seven members of Council and all eight of us are elected by the residents of Chagrin Falls to govern this Village. Now, I would like to invite each of our Chinese guests to come up and I would like very much to shake your hand. Mayor Brick said now, I would like to read a special proclamation. He said on behalf of the entire Village, I would like to present Mrs. Ren with a flag of the Village of Chagrin Falls and a key to the Village. Welcome all of you to Chagrin Falls; enjoy your stay. We are so glad you could be with us.

Mayor Brick said I hope you’ve all had a chance to review the two reports on our proposed police station. And, as I hope you can see, these technical reports confirm that the Solon Road site is safe and the proposed design is the most economical choice. There are copies of the reports available and they should be on the website.

Mayor Brick reported that Behnke & Associates has completed their final report recommending interconnecting trails in the Chagrin Valley. Copies can be downloaded from the Village website or from the Behnke & Associates website.

Mayor Brick mentioned that Solon Road, west of Cannon Road, will be closed until September 2nd.
Mayor Brick said don’t forget the Village annual yard sale will be held on Saturday, September 11th.

Mayor Brick said the Chagrin Documentary Film Festival will be held here in the Village from October 12th to October 16th.

REPORT OF THE LAW DIRECTOR

SECTION 1309.01 OF THE CODIFIED ORDINANCES AMENDED
Mr. Patton introduced Ordinance No. 2010-42 entitled:

AN ORDINANCE AMENDING SECTION 1309.01 OF THE CODIFIED ORDINANCES FOR THE VILLAGE OF CHAGRIN FALLS TO AUTHORIZE A PERMIT FEE OF TWICE THE AMOUNT ORDINARILY CHARGED WHEN WORK IS PERFORMED WITHOUT THE NECESSARY VILLAGE PERMIT, AND DECLARING AN EMERGENCY.

Moved by Mr. Patton, seconded by Mr. Williams that the requirement for reading an ordinance three times be suspended. Carried. Ayes: Evans, Jacobs, Lutz, Milko, Patton, Subel, Williams. Nays: None. Moved by Mr. Patton, seconded by Mrs. Evans that the ordinance be adopted. Carried. Ayes: Evans, Jacobs, Lutz, Milko, Patton, Subel, Williams. Nays: None. Mr. Patton said our Codified Ordinances require plans and specifications to be filed with the building inspector prior to the issuance of a building permit and if this mandate is inadvertently ignored, or for that matter intentionally ignored, there is additional time and expenses incurred by the Village and this ordinance calls for the payment of twice the ordinary amount charged in the event that a building permit is not properly issued in the first instance. Paragraph A of the legislation is unchanged. Paragraph B contains the new language, which addresses the fees that are contained in this ordinance.

PUBLIC SAFETY DECLARED A TOP PRIORITY
Mr. Patton introduced Resolution No. 2010-43 entitled:

A RESOLUTION DECLARING PUBLIC SAFETY A TOP PRIORITY OF THE VILLAGE; FINDING AN ADEQUATE POLICE STATION TO BE AN INTEGRAL COMPONENT OF THE VILLAGE’S ABILITY TO PROVIDE COMPREHENSIVE PUBLIC SAFETY SERVICES; INVITING VILLAGE RESIDENT TO VISIT THE CURRENT VILLAGE POLICE STATION; ENCOURAGING ELECTORS TO VOTE “YES” ON ISSUE 2; AND DECLARING AN EMERGENCY.

Mr. Patton said this resolution declares that public safety is a top priority and that we need an adequate police station facility as a part of providing public safety services. It also encourages our residents to tour the current police station if they have not already done so. I would like to make an amendment to this particular resolution. You will note that in the fifth whereas it states “the current police station fails to meet law enforcement accreditation standards and Ohio building code requirements”. Mr. Patton said I would like to make a motion to amend that to state whereas “the current police station fails to meet law enforcement accreditation standards relative to the facility and Ohio building code requirements”. The motion was seconded by Mrs. Evans. Carried. Ayes: Evans, Jacobs, Lutz, Milko, Patton, Subel, Williams. Nays: None. Moved by Mr. Patton, seconded by Mrs. Evans that the resolution be adopted. Carried. Ayes: Evans, Jacobs, Lutz, Milko, Patton, Williams. Nays: Subel.

COUNCIL’S INTENTION TO MAKE THE VILLAGE A “GREENER” GOVERNMENT DECLARED
Mr. Patton introduced Resolution No. 2010-44 entitled:

A RESOLUTION DECLARING THIS COUNCIL’S INTENTION TO MAKE THE VILLAGE A “GREENER” GOVERNMENT BY INCORPORATING BIO-BASED PRODUCTS, OF EQUAL OR HIGHER QUALITY AND AVAILABLE FOR AN EQUIVALENT PRICE, INTO THE VILLAGE’S DAILY OPERATION, AND DECLARING AN EMERGENCY

Moved by Mr. Patton, seconded by Mr. Williams that the resolution be adopted. Carried. Ayes: Evans, Jacobs, Lutz, Milko, Patton, Subel, Williams. Nays: None. Mr. Patton said this is green legislation creating a bio-preferred purchasing procedure which is consistent with recent state law and to help protect our environment and to reduce the country’s dependence on foreign oil and to eliminate unnecessary waste. In the event that bio-based products are available with an equal or higher quality and are at an equivalent or better price then we will utilize the bio-based products.

Mr. Williams reported that our regularly scheduled Board of Zoning Appeals meeting for tomorrow night has been canceled. There are currently no variances pending review by our Board.

PARKS COMMISSION

Mrs. Lutz reported that the Parks Commission meets tomorrow at 8:30 a.m. at Riverside Park to review the improvements to the playground.

Mrs. Lutz reported that Van Curen is out trimming the tree lawn trees and they will be out for a while.

ARTS COMMISSION

Mr. Milko announced a meeting for Monday, September 20, 2010 at 6:00 p.m.

Henry Piper pointed out a number of things that he takes issue with regarding the engineer’s report on the new police station site. Mr. Lannon and Mr. Patton answered Mr. Piper’s questions.
