The meeting of the Council of the Village of Chagrin Falls was called to order at 8:00 p.m. by Mr. Patton.
Member present: Evans, Jacobs, Milko, Patton, Subel, Williams

Moved by Mrs. Evans, seconded by Mr. Williams that the absence of Mrs. Lutz be excused. Carried. Ayes: Evans, Jacobs, Milko, Patton, Subel, Williams. Nays: None.
APPROVAL OF MINUTES
Moved by Mr. Williams, seconded by Mrs. Evans that the minutes of the meeting held October 10, 2011 be approved. Carried. Ayes: Evans, Jacobs, Milko, Patton, Subel, Williams. Nays: None.
REPORT OF THE MAYOR
Mayor Brick read a proclamation honoring David Griffiths, a former Councilman who passed away.
Mayor Brick said Chief Brosius, Mr. Subel, and I attended the Efficient Government Collaboration Conference in Akron on October 13th to be sure we are kept up to date on any possible collaboration projects that could help the Village. I was able to meet with Ed Jerse who is the Collaboration Director of Cuyahoga County to tell him we wanted to collaborate and, in fact, we were looking for grants for a dispatch center. And, I met Paul Alsenas, the Cuyahoga County Planning Director, and he is coming to my office this Thursday to discuss collaboration opportunities. So, I don’t know what those are yet but I will certainly keep you posted.
Mayor Brick said for a variety of reasons we now have openings on three of our commissions; planning and zoning, shade tree, and cemetery board. I am asking for volunteers to fill these spots.
Mayor Brick read a proclamation recognizing the work and wonderful impact that Connie DeGood has had on the Village.
Mayor Brick said I hope you will all enjoy our Halloween trick-or-treating this year, next Monday evening, October 31st from 6:00 p.m. to 8:00 p.m.

CUYAHOGA COUNTY BUSINESS ATTRACTION AND ANTI-POACHING PROTOCOL ADOPTED
Mr. Byron placed on the floor Resolution No. 2011-58 entitled:
A RESOLUTION ADOPTING THE CUYAHOGA COUNTY BUSINESS ATTRACTION AND ANTI-POACHING PROTOCOL, AUTHORIZING THE MAYOR TO ENTER INTO THE BUSINESS ATTRACTION AND ANTI-POACHING PROTOCOL AGREEMENT AND DECLARING AN EMERGENCY.
Mr. Patton said this will remain on readings.
SECTION 1125.06 AMENDED
Mr. Byron placed on the floor Ordinance No. 2011-60 entitled:
AN ORDINANCE AMENDING SECTION 1125.06, LANDSCAPING REQUIREMENTS, OF THE CODIFIED ORDINANCES OF THE VILLAGE OF CHAGRIN FALLS BY ENACTING NEW SUBSECTION (f) RELATING TO MAINTENANCE OF LANDSCAPING AND REPLACEMENT OF LANDSCAPING.
Mr. Jacobs explained the amendments and he said this will remain on readings.
TRANSFERRING AND APPROPRIATING FUNDS
Mr. Patton introduced Ordinance No. 2011-63 entitled:
AN ORDINANCE TRANSFERRING FUNDS AND APPROPRIATING FUNDS.
Moved by Mr. Patton, seconded by Mrs. Evans that the requirement for reading an ordinance three times be suspended. Carried. Ayes: Evans, Jacobs, Milko, Patton, Subel, Williams. Nays: None. Moved by Mr. Patton, seconded by Mr. Williams that the ordinance be adopted. Carried. Ayes: Evans, Jacobs, Milko, Patton, Subel, Williams. Nays: None. Mr. Patton said this is for the purpose of transferring recently received estate taxes in the amount of $32,578.63 from the general fund to the capital improvement fund. This will likely be the last estate tax distribution for 2011 and this brings our total receipts for Ohio estate taxes to $489,000.
AUTHORIZATION TO ENTER INTO AN EASEMENT AGREEMENT
Mr. Patton introduced Ordinance No. 2011-64 entitled:
AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO AN EASEMENT AGREEMENT WITH ROBERT AND LYNN ALEKSOV, JAMES AND CHRISANNE BEGAM, EDWARD AND JOANNE COWAN, AND THOMAS AND KATHLEEN HAVENER, AND DECLARING AN EMERGENCY.

CHAPTER 1142 AMENDED
Mr. Jacobs introduced Ordinance No. 2011-65 entitled:
AN ORDINANCE AMENDING CHAPTER 1142, LANDSCAPING REGULATIONS, OF THE CODIFIED ORDINANCES OF THE VILLAGE OF CHAGRIN FALLS BY ENACTING NEW SECTION 1142.09, RELATING TO MAINTENANCE OF LANDSCAPING AND REPLACEMENT OF LANDSCAPING.
Mr. Jacobs explained the amendments and placed this ordinance on readings.
SECTIONS 1137.02 AND 1138.02 AMENDED
Mr. Jacobs introduced Ordinance No. 2011-66 entitled:
AN ORDINANCE AMENDING SECTIONS 1137.02 AND 1138.02, PERMITTED USES, OF THE CODIFIED ORDINANCES OF THE VILLAGE OF CHAGRIN FALLS TO PROVIDE THE PERMITTED USES, EXCEPT AS OTHERWISE PROVIDED, SHALL BE CONDUCTED WHOLLY WITHIN ENCLOSED BUILDINGS.

SECTION 715.01 AMENDED
Mr. Jacobs introduced Ordinance No. 2011-67 entitled:
AN ORDINANCE AMENDING SECTION 715.01 OF THE CODIFIED ORDINANCES OF THE VILLAGE OF CHAGRIN FALLS RELATING TO THE DEFINITION OF AN AMUSEMENT MACHINE AND DECLARING AN EMERGENCY.
Moved by Mr. Jacobs, seconded by Mr. Milko that the requirement for reading an ordinance three times be suspended. Carried. Ayes: Evans, Jacobs, Milko, Patton, Subel, Williams. Nays: None. Moved by Mr. Jacobs, seconded by Mr. Williams that the ordinance be adopted. Carried. Ayes: Evans, Jacobs, Milko, Patton, Subel, Williams. Nays: None. Mr. Jacobs said this actually brings our code up to date so that it deals with electronic gambling. There is no current problem, it just prevents problems from occurring.

Chief Zugan reported that on October 9th, as part of fire prevention week, twenty-six Village residents brought their fire extinguishers to the fire department and had them checked and refilled. Chief Zugan also reported that, in conjunction with trick-or-treat hours, the fire department will hold its 13th annual haunted fire house.

Katherine Malmquest reported on the progress of the improvements to the Chagrin Falls Library building. She also mentioned that they are having a Fall Festival tomorrow night to make street puppets. On Saturday they will have a parade of puppets at 2:00 p.m.
